Thanks guys for the support. This was by far the shittiest day of my life. My house is virtually empty and my sons room is vacant. That is the hardest thing for me to handle. I feel so empty inside. If I only knew she was going to take him from me I'd would have spent a little more time with him. I miss him so much. I'm sorry to burden you guys about this but I have to get it off my chest.

On a side note, We have been talking to lawyers and my wife lied to her attorney about her time as a Montana resident. I have the exact date to which we crossed the Montana border which means the amount of time she has lived her. she told her attorney it was less than six months which by her account makes her a ND resident but in all actuality it was more than that which makes her a MT resident. I don't know what grounds I have to stand on this but I'm going to try. You do not take a child from their parent basically in the middle of the night for no reason. She knew she was filing for divorce. Which is why she was in such a hurry to get back To ND. So she took Jackson so I could not say good bye knowing I nor any member of my famil;y would not see him again unless we drive to Fargo. Because since she filed in North Dakota, even though we are married still and I am his dad I cannot take my own son out of ND, unless I want to be thrown in Jail. I'm so pissed about this. I need to find an attorney who is liscenced in MT as well as ND otherwise I have to find a ND attorney. I'll keep you posted the drama will continue.

Yeah I know, somehow sdhe was able to come up with 5 grand to get hers with the help from someone in her family. I was the very last person to know about this. Her family knew, including grandpartents and aunts, in fact her Grandma got her apartment for her last week. Her work knew and our old daycare person knew about this divorce before I did, pretty sweet huh? Nothing makes a person feel good to know they are not even good enough to know they are being left by their family until an hour before their family leaves. Can life get any better. I'm sorry for bringing you down, it just helps to talk about it. I'd talk to the cat but she is asleep.

She took him without your knowledge and or consent.
That is kidnapping in my eyes!
You really need to find the exact time you guys have been here and what MT state law is regarding how long you have to live in state to be considered a MT resident. If you guys have legally become MT residents then you could file against her for taking your child out of state without consent.

This whole thing is soooo messed up and I feel for you Matt!
What kind of mother takes a child away from their other parent in the middle of the night like that?? Sounds like she is unstable.
My biggest piece of advice to you is to start writing down EVERYTHING. When she calls, what she talks about, how her attitude is. Believe me, it all comes into play in the court of law! I know this from experience.
Does she let you talk to Jackson on the phone? If not then I would again file a kidnapping report. No matter if your in the middle of a divorce(much less one you didn't even know was about to happen) you still have the right to keep in contact with your son!!!!!!!!!!!!!!!!!!
It's extrememly selfish her actions. If she loved your son as much as you she would have discussed this whole situation with you before taking any of the actions she has!!!!!
